1. Acceptance of Terms

By accessing or using Brelio ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and [Company Name, Inc.] ("we," "us," "our"), the operator of Brelio. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Brelio is an AI-powered image generation platform that enables users to:

  • Generate images using artificial intelligence models (including Google Gemini and OpenAI GPT Image)
  • Brainstorm creative concepts through conversational AI interaction
  • Organize work within personal workspaces
  • Upload brand assets (logos, URLs) for AI-assisted brand extraction and consistent visual output
  • Export, download, and manage generated images

The Service is provided on a subscription basis. There is no free tier — all users must have an active paid subscription to use the Service.

3. Account Registration & Security

To use Brelio, you must create an account by providing a valid email address and password. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.

4. Subscription & Billing

4.1 Subscription Tiers

Brelio offers paid subscription plans (Starter, Pro, and Enterprise). Each plan includes a monthly allocation of generation tokens. Details of each plan, including pricing and token allowances, are available on our pricing page.

4.2 Token System

Image generation consumes tokens from your subscription balance. Token costs vary depending on the AI model used, image resolution, and other generation parameters. Optional token packs may be purchased for additional generation capacity beyond your plan's monthly allowance.

4.3 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By subscribing, you authorize recurring charges to your payment method at the beginning of each billing period.

4.4 Refund Policy

Subscription fees are generally non-refundable. However, if you experience a significant service disruption caused by us, you may request a pro-rated credit by contacting our support team. Token packs are non-refundable once purchased. If an AI generation fails due to a system error (not a content policy rejection), the tokens consumed will be automatically refunded to your balance.

5. Acceptable Use

You agree not to use the Service to generate, upload, or distribute content that:

  • Is illegal under applicable law, including but not limited to EU and Lithuanian law
  • Constitutes or promotes hate speech, discrimination, or violence against individuals or groups
  • Depicts child sexual abuse material (CSAM) in any form
  • Creates deepfakes or realistic likenesses of real persons without their explicit consent
  • Infringes on trademarks, copyrights, or other intellectual property rights of third parties
  • Is intended to deceive, defraud, or mislead others (including generating fake documentation or credentials)
  • Contains malware, spam, or any other harmful content

Violation of this Acceptable Use policy may result in immediate account suspension or termination, without refund. We may also report illegal content to the appropriate law enforcement authorities.

6. AI-Generated Content

6.1 Ownership

You retain ownership of images generated through the Service using your prompts and creative direction. You may use generated images for personal and commercial purposes, subject to these Terms and applicable law.

6.2 License to Us

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use generated images and associated prompts solely for the purposes of operating, improving, and maintaining the Service (including training and fine-tuning our systems). This license does not permit us to sell or publicly distribute your generated content.

6.3 No Guarantee of Uniqueness

AI-generated images are produced by machine learning models and may not be unique. Other users with similar prompts may receive similar or identical outputs. We make no guarantee that generated images are original or free from resemblance to existing works.

6.4 No Guarantee of Accuracy

AI outputs may contain errors, inaccuracies, or artifacts. Generated images should not be relied upon as factually accurate representations. You are solely responsible for reviewing and verifying the suitability of generated content before use.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its user interface, design, branding, source code, algorithms, and documentation, is the intellectual property of [Company Name, Inc.] and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7.2 Your Intellectual Property

You retain all rights to content you upload to the Service, including brand assets, logos, reference images, and brand profile data. By uploading content, you grant us a limited license to process that content solely to provide the Service (e.g., brand extraction, prompt generation).

8. Content Moderation

The AI models used by Brelio include built-in content safety filters provided by their respective providers (Google, OpenAI). These filters may automatically reject prompts or outputs that violate the providers' content policies.

In addition, we reserve the right to:

  • Review generated content for compliance with our Acceptable Use policy
  • Remove or disable access to content that violates these Terms
  • Report illegal content to law enforcement as required by applicable law

Content rejection by AI safety filters does not consume generation tokens.

9. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal data. The Privacy Policy is incorporated into these Terms by reference.

10. Service Availability & Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Service Level Agreements (SLAs) are available only for Enterprise-tier subscribers under separate written agreements.

We reserve the right to:

  • Modify, update, or discontinue features of the Service at any time with reasonable notice
  • Perform scheduled maintenance that may temporarily interrupt the Service
  • Change the AI models used for image generation, which may affect output quality or characteristics
  • Adjust token pricing or subscription plan details with 30 days' advance notice to existing subscribers

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.
  • Our total aggregate liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
  • We are not liable for the actions, outputs, or content policies of third-party AI providers (Google, OpenAI) whose models power the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable EU or Lithuanian law, including liability for fraud or willful misconduct.

12. Termination

12.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms, including the Acceptable Use policy
  • Your account is involved in fraudulent or illegal activity
  • You fail to pay subscription fees after reasonable notice

12.3 Effect of Termination

Upon account closure, your generated images and workspace data will be retained for 30 days, during which you may request a data export. After 30 days, your data will be permanently deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania and applicable European Union regulations, including the General Data Protection Regulation (GDPR).

Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania, unless applicable EU consumer protection law grants you the right to bring proceedings in your country of residence.
